Terms and Conditions
These terms and conditions govern participation in The Lumen Prize, administered by Lumen Prize Foundation, Inc. (the "Organizer"). Please read each section carefully. By submitting an entry, you accept these terms in full.
Note to Entrants
The Lumen Prize Foundation, Inc. is a nonprofit corporation registered in Delaware. All revenue from entry fees and related activities is used exclusively to manage the competition, award prizes, and organize exhibitions and events that advance our mission of promoting art created with technology. The Organizer does not profit from entry fees or other competition-related revenue.
Entry Conditions
1.1 Works may be entered by individual artists or collectives. In the case of collectives, all contributing artists must clearly be identified in the appropriate section of the entry form. The Organizer cannot be held responsible for any misrepresentation of a collective or partnership if this form is not correctly filled in at the entry stage.
1.2 To apply, entrants must complete and submit the online application form.
1.3 Artists and/or Collectives may enter as many works as they like. Entry fees and prize amounts for the current competition year are available at www.lumenprize.org.
1.4 Works that have won other prizes are eligible for entry as long as the entrant retains ownership of the work.
1.5 The Organizer will not accept digitised versions of work done by traditional means such as oils, watercolours, pen and ink, etc, unless these versions have been artistically manipulated by computer software and this process is an intrinsic part of the work.
1.6 Lens-based photography is permitted where some form of digital or other manipulation is an intrinsic part of the work.
1.7 Work must be created, at least in part, on digital devices such as tablets, digital cameras, smartphones or computers. Physical artworks are eligible if a digital element is a significant factor in the concept or execution of the work.
1.8 Specifications for entry: Entrants shall provide materials as specified in the current year's submission guidelines available on the submission platform. Entries with sound are welcome but the entrant must own the copyright to the sound used. If the sound is created by another individual, permission must be granted and credit given.
If your work is site-specific, please identify the site where the work was installed.
The same work may be entered in different categories but this will require a separate entry for each category chosen.
1.9 The Organizer does not account or have any liability for any participants' bank fees and charges that may be levied in currency conversion and currency transactions by the participating bank or institution. Prizes are paid in US Dollars via the application platform.
1.10 The payment of the entry fee must be made via the submission platform.
1.11 Call for Entries dates are published annually at www.lumenprize.org.
1.12 Call for Entries deadline may be extended at the discretion of the Organizer.
1.13 Entry limits for specific categories, if any, will be stated in the annual Call for Entries and allocated on a first-come, first-served basis.
Selection of Works
2.1 Lumen's International Selectors Committee ("ISC") will choose works for the Lumen Prize Finalists.
2.2 The Lumen Jury Panel will select the prize winners.
2.3 The notification to successful entrants will be made individually by the Organizer via the email address specified on the application form. Artists whose works have not qualified as a finalist will not be individually notified. If your work has not been included as a finalist, we regret that we do not have the resources to provide feedback.
2.4 Entrants may at any time notify the Organizer at info@lumenprize.org if they wish to remove their work(s) from the competition after submission. Please note that once a work has been submitted, the entrance fee cannot be refunded.
The Entrant's Responsibility
The entrant(s) warrants and represents as follows:
3.1 The entrant(s) is / are the sole owner, creator and author of each entry. The Organizer cannot be held responsible for any misrepresentation of a collective or partnership if the entry form is not completely filled in and all contributing artists named in full.
3.2 The entrant(s) has / have the right and full authority to make the entry available to The Lumen Prize.
3.3 Each entry does not contain any infringing, threatening, false, misleading, abusive, harassing, defamatory, pornographic, obscene, scandalous, inflammatory, or profane content.
3.4 Each entry does not contain any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise offend against any other law.
3.5 Each entry does not infringe the copyrights (and related rights), trademarks, design rights, or any other intellectual property rights of any third person, artist group or entity, or violate any person's rights of privacy or breach the contract rights of any third party.
3.6 The entry should not include:
Trademarks owned by third parties.
Copyright materials owned by third parties unless used in accordance with fair use principles or other applicable copyright exceptions, or with proper authorization.
Names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead unless used in a transformative manner or with proper authorization.
Material for which the entrant has not purchased or secured the rights to use, such as stock image.
Material which contains any commercial content that promotes any product or service unless the appropriate written consents from the relevant rights owners have been received.
Material which has been substantially derived from an existing artwork and thus can be perceived as infringing on the intellectual property rights of the creator of that artwork without consent of that creator or artist.
3.7 If your work incorporates third-party materials under fair use, transformative use, or other copyright exceptions, you must clearly document and explain this use in the submission form, including the artistic justification and how the use is transformative. The Organizer may remove entries if fair use claims are not sufficiently documented or appear questionable.
3.8 The entrant shall fully indemnify and keep indemnified and hold the Organizer harmless against all and any claims, demands, loss, damages, liability and costs (including reasonable legal expenses) that the Organizer suffers or incurs as a result of, or in connection with, any breach by the entrant of the warranties in clauses 3.1-3.6 above. In such circumstances, the works subject to any claim or demand will be suspended from the competition pending a final decision of such claim.
3.9 The Organizer reserves the right and without any liability to the entrant to remove any entries that it considers do not comply with these terms or are in conflict or otherwise contradict any applicable laws or where the Organizer considers, in its sole discretion that the entrant may have engaged in any improper conduct which may affect the reputation and standing of The Lumen Prize or where the Organizer has any other concerns either about the entrant or the entrant's work. The Organizer will provide written notice and explanation when exercising this right.
3.10 By entering the competition, the entrant agrees and acknowledges that the Organizer is permitted to receive the entrant's application and personal data. All personal information will be used by the Organizer in accordance with its Privacy Policy. The entrant warrants that their entries comply with these terms and conditions and that they have read and understood the Privacy Policy.
Intellectual Property
4.1 By entering the competition, entrants do not transfer or surrender the copyright or other intellectual property rights in their work. By submitting an entry, if selected as a finalist or winner, the artist grants the Organizer royalty-free, non-exclusive worldwide rights to reproduce and display the work for promotional purposes related to The Lumen Prize, including exhibitions, publications, and marketing materials. These rights do not include commercial licensing or sale of the work.
4.2 The display of artworks at events will always be determined in consultation with the artist. Finalists and winners are not required to participate in exhibitions or events, though participation is encouraged. The Organizer will make reasonable efforts to accommodate artists' preferences regarding exhibition of their work.
4.3 Winning and finalists' works may be used in press releases for events and shows associated with the Organizer from time to time. The Lumen Prize does not assume responsibility for the quality of third-party reproductions in Lumen Prize publications, exhibition materials, or website.
Judging and Determinations
5.1 The Organizers' Liability: The Lumen Prize does not exclude or limit its liability for any liability that may not, by law, be limited or excluded. The Lumen Prize accepts no liability in relation to an entrant's participation (or inability to participate) in the competition, including without limitation any use made by a winner of (or inability to use) the Prize, to the maximum extent permitted by law.
5.2 If the competition cannot be executed at all or as planned and the failure or delay is caused by circumstances beyond The Lumen Prize's reasonable control, including technical problems, earthquake, severe weather and other acts of God, riot, sanctions, embargoes, war, strike, failure of transportation and/or public telecommunication networks The Lumen Prize shall not incur any liability and no payment or prize of any kind for such competition will be awarded.
5.3 The Lumen Prize's determination and decision on all matters will be final and no correspondence will be entered into. Any dispute or situation not covered by these Terms and Conditions will be resolved by The Lumen Prize's management in a manner it deems to be the fairest to all concerned and, subject to the following section, that the decision will be binding on all entrants.
Applicable Laws and Jurisdiction
6.1 This competition and these Terms and Conditions shall be governed by Delaware law, and the parties submit to the exclusive jurisdiction of the Delaware courts in relation to any disputes arising between them under or in relation to the competition and these Terms and Conditions.
6.2 If any part of these promotional terms is found to be unenforceable as a matter of law, all other parts of these promotional terms shall be unaffected and shall remain in force.
6.3 Before initiating any legal proceedings, parties agree to first attempt to resolve any dispute arising from this competition through good faith negotiation. Either party may initiate this process by sending written notice to the other party describing the dispute. The parties shall have thirty (30) days from receipt of such notice to attempt to resolve the dispute informally. If the dispute cannot be resolved through negotiation, either party may pursue remedies available under Delaware law as specified in Section 6.1.
Data Protection
7.1 By entering the competition, an entrant agrees to the personal information in his/her/them application being processed by The Organizer for the purposes of administration of the competition. All submitted materials, including images, videos, and artist statements, will be retained by the Organizer indefinitely for archival and historical purposes related to the competition. Personal data will be processed in accordance with applicable data protection laws. For more information on data retention and your rights, please see our Privacy Policy.
Winners' Details
8.1 The Jury Panel's decision is final, private and not subject to any queries or public investigations. The Organizers will not enter into any correspondence regarding the Jury Panel decisions.
8.2 By filling in the online application form, the participants agree with the articles of these Terms and Conditions, as well as with the use of their names, images, voices and photos for promotional purposes related to the competition and associated exhibitions.
8.3 Questions regarding the selection process will be resolved by the Organizer in accordance with consumer protection laws. There will be no appeal of any type regarding the Organizer's decisions.
General
9.1 The Organizer assumes no responsibility for technical failures, including but not limited to hardware or software malfunctions, network issues, data transmission errors, viruses, unauthorized access, or any other technical problems that may affect entry submission or viewing.
9.2 In no event will the Organizer, its parents, affiliates, subsidiaries and related companies, its advertising or promotion agencies, or its officers, directors, employees, shareholders, representatives or agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any contestant's access to and use of the website (www.lumenprize.org). Without limiting the generality of the foregoing, everything on the Website is provided "as is", without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for purpose/use or non-infringement.
Privacy Policy
This Privacy Policy explains what information we collect about you, how we use it, who we share it with, and your choices regarding that information. Terms used in this Privacy Policy have the same meaning as in the Lumen Prize Competition Terms & Conditions.
By using our website, subscribing to our emails, or providing information to us, you accept this Privacy Policy and consent to our collection and use of your personal information as described below.
